ORDINANCE TO AMMEND THE ZONING ORDINANCE (2012) OF THE TOWNSHIP OF PLEASANTVIEW
Boynaire Planned Unit Development Uses and Regulations

SUMMARY: This ordinance amends the 2012 Zoning Ordinance for the Boynaire planned unit development from Farm-Forest-Residential-2 (FFR-2) zone district to Residential-1 (R-1). The Boynaire plot was approved by the Township in the early 1970s for residential development applying the zoning regulations at that time. The historic record also notes that the development should be utilized as a template and standard in the future. Since the inception, zoning permits have been issued for residential development as a R-1 zoning district. In 2023 through 2024, reviews of the historical record yielded an oversight in the 2012 Zoning Ordinance and absence of explanation for increasing setbacks, limiting building, and restricting development of the Boynaire properties as a FFR-2 district. Updates to the Township Mater Plan are pending.

COMPATIBLE RENEWABLE ENERGY ORDINANCE (CREO)
SUMMARY: This ordinance empowers the Township to designate Renewable Energy District(s), oversee the application process for renewable energy facilities, and receive revenues that meet the capacity and additional criteria set forth within and as a CREO within the State legislative Acts. The Michigan Act 233 of 2023 provides siting authority, that is, Michigan Public Service Commission and local government with compatible renewable energy ordinance (CREO), to the utility-scale wind, solar, and energy storage facilities under certain conditions. Also, the Michigan ACT 108 of 2023, also known as the Solar Energy Facilities Taxation Act, provides a tax incentive to owners of utility-scale solar energy generation facilities who build a new solar energy and provides local governments a guaranteed and stable revenue stream from the solar energy generation facilities.
